More details

The GDPR applies to every organisation that processes personal data of EU residents. For marketers this means: explicit consent for non-essential cookies, clear information about how data is used, and secure data storage. Non-compliance can lead to fines of up to 4% of global annual turnover.

For example…

On 2 September 2021 the Irish regulator fined WhatsApp €225 million, at the time the highest fine the DPC had ever issued. The case was not about data breaches or misuse, but purely about transparency: WhatsApp had not informed users clearly enough about how their data was processed and, according to the decision, provided only 41% of the required information. The original proposal was 30 to 50 million; eight other European regulators considered that too low, after which the fine more than quadrupled.
